The objective of renter selection is to make a careful, evidence-based decision using relevant information and a consistent process. It should never rely on unlawful assumptions or collect personal information that is not permitted or necessary.

Use the prescribed application process

From 31 March 2026, Victorian rental providers and agents must use the prescribed rental application form and follow rules limiting the information that can be requested. The current form and guidance should be used for every campaign.

Assess relevant information consistently

  • Identity and the information permitted by the prescribed form
  • Capacity to pay the advertised rent
  • Relevant rental history and references
  • Proposed commencement date and agreement requirements
  • The same documented decision criteria for each applicant

Protect privacy and avoid discrimination

Personal information should be collected, used, stored and destroyed in line with current Victorian requirements. Selection decisions must not be based on protected personal characteristics.

A rental provider may choose the most suitable applicant, but the recommendation needs to be based on lawful and relevant considerations.
